Gun in Merriam incident determined to be a toy; no charges filed for pointing it at student walking home from school

No criminal charges will be filed against teenagers who pointed a gun at a Hocker Grove Middle School student walking home from school on Monday. The gun turned out to be an airsoft pistol, Merriam police said Friday. Because it is considered a toy and not a deadly weapon by law, no charges will result.

Detectives were able to identify the green truck involved in the incident earlier this week. The case was reviewed by the Johnson County District Attorney’s Office to determine if any charges would be filed.

Airsoft guns normally fire plastic pellets, often using either compressed gas or a spring-driven piston. The guns have the tips painted orange to identify them as toys or non-lethal guns, but the pellets sting when they make contact. They are sold in a variety of styles.

Police had issued a call for help after the incident to identify three juveniles in a green pickup truck with a stripe down the middle. According to reports, one of the passengers in the truck pointed a gun at a student walking home from Hocker Grove Middle School Monday afternoon. Other Hocker Grove students witnessed the incident, which happened at 57th and Perry Lane in Merriam.

The original reports from Merriam police said a white male passenger pointed a hand gun at the student. One of the truck’s passengers was described as having orange hair. A Fox 4 report said the passenger cocked the gun twice.
