Judge dismisses parents’ suit against Kansas school funding formula

U.S. District Judge John Lungstrum late last week dismissed a law suit filed by a group of local parents challenging the state’s school funding formula.

In granting a motion for dismissal filed by Kansas officials including Gov. Sam Brownback, Lungstrum argued that a constitutional challenge to the state’s Local Option Budget rules would effectively dismantle the entire school funding formula.

“The court concludes that the Local Option Budget cap is not severable from the rest of Kansas’ statutory public school funding scheme; thus if plaintiffs were to prevail on their claim that the cap is unconstiutional, the entire scheme would be struck down,” Lungstrum wrote.
